Course Description:
This course surveys the vast universe of rules and regulations that literally impact every citizens’ life from cradle to grave. Federal government agencies are authorized by Congress through “enabling legislation" to promulgate regulations. There are more than 450 departments, agencies, and sub-agencies in the U.S. federal government. The Code of Federal Regulations, the official repository of published rules, exceeds 180,000 pages, in 200 volumes, organized in 50 subject-matter titles. And all 50 states have administrative agencies that similarly issue and enforce regulations. No one knows for sure the total number of laws and regulations on the books – various numbers are purely an estimate. There are so many laws and regulations that experts cannot agree on how to count them.
The number and impact of all these agencies and rules
have led many to refer to our government as The
Regulatory State. These regulations, which have the full
force of law, impact our lives daily from cradle to
grave. In this course we study how and why rules are
issued, and how they are enforced. We survey this area of
the law, called administrative law, across the range from
Constitutional law, through the history and explosion of
regulations, and finally through the current challenge of
issuing regulations needed to keep up with the speed of
technological innovations such as artificial intelligence
and cybersecurity.
