Course Description:
Most Americans will confront a civil justice problem this year—an eviction notice, a debt collector's call, a custody dispute, a denied benefits claim—and most will face it alone, without a lawyer. In this seminar, we will investigate what “access to justice” requires in state court civil dockets, from structural inequities to on- the-ground realities. Students will review empirical and theoretical scholarship, conduct court observations, and learn from ongoing reform efforts in Arizona and around the country. As a final project, students will draft a paper either advancing our understanding of an access-to- justice problem in Arizona or proposing a reform—such as a new law, rule, or policy change—designed to improve access to justice for our neighbors.
