Course Description:
This class will consider contrasting views of the respective authority of the President and the Supreme Court during critical periods in our constitutional history. Examples include the election of 1800, the Civil War, the Great Depression, World War II, the Watergate scandal, and the post-9/11 “war on terrorism.” Against this backdrop, the class will consider pending Supreme Court cases concerning presidential powers, including oversight of administrative agencies, determination of economic policy, and the use of military force.
