Course Description:
This course will expose you to contemporary issues at the intersection of law, culture, and the arts. Among other questions, we ask: how does the law regulate artistic practice? How does it engage with the way we produce culture? How does our shared culture impact what art is protected? And, when does culture become ownable under intellectual property and other laws? The course will necessarily ground students in core copyright, trademark, and other intellectual property doctrines that govern the creation and use of art and culture. But we will also explore other key areas of the law, such as speech protections, cultural resources laws, and privacy. In this course, students will grow their knowledge and hone their skill at applying art and culture law to some of the most challenging issues affecting contemporary society while also developing a number of critical lenses for assessing the relative strengths and weaknesses of these legal regimes.
