Course Description:
This course will teach two things: (1) the substantive law and rules of bankruptcy chapter 11 business reorganizations and (2) the courtroom skills needed to be an effective attorney in a chapter 11 case, which skills are generally applicable to any trial court. The professors have combined almost 100 years' experience in complex chapter 11 bankruptcy cases and bring to the course both the judicial and practitioner's perspectives. The course will also utilize guest lecturers in the areas of understanding financial concepts necessary for a chapter 11 case. Regardless of whether a student desires to be a "courtroom lawyer", knowing how to effectively prepare and present aspects of a chapter 11 restructuring are essential to the negotiation of any restructuring.

The class will be interactive with student participation expected in each class. There will not be a traditional final exam. Grades will be based on studentsā€˜ performance in two exercises in moot court type proceedings based on a hypothetical bankruptcy case as if in a bankruptcy courtroom and classroom performance/participation. Students will be graded on: 1. Preparation (understanding of pertinent facts and applicable legal issues); and 2. Effectiveness of Presentation to Court (clarity of explanation of relief sought, organization of presentation to Court, effectiveness of responding to questions from Court, effectiveness of responding to specific objections raised, and poise under pressure).
