Course Description:
The class will meet January 6, 7, 8, and 9 from 9:00 am - 12:15pm. A two hour written exam will be administered at 9:00 am on Friday, January 10th

The course addresses the question of the gradual convergence between national legal systems in Europe and the role assigned by European lawyers to the “legal culture” to explain, encourage or refrain this phenomenon. Whether hostile or favorable to the European integration, many commentators support their opinion by the requirements of the national or the European “legal culture”. The readings will provide the students the tools to assess the merits of these opinions. To avoid preconceived answers, the discussion will be based on first-hand materials: judgments, acts, European and national reports, rather than comparative law studies.

Day 1: Introduction: Historical and Political Aspects of the “European Legal Culture”

Day 2: The Standardization of Fundamental Rights

Day 3: The Harmonization of the Civil Procedure

Day 4: The Convergence of the Law of Obligations
