Course Description:
The use of alternative dispute resolution has been most extensive in the area of employment law. Mediation and arbitration are widely used not only in the collective bargaining setting, but also in virtually every aspect of the employment relationship. This course will offer the student a comprehensive review of the subject with special emphasis on the extensive body of law that has developed in regulating employer-imposed arbitration. The discussion of mediation will include use of simulations to enable the students to understand how mediation can effectively resolve employment disputes. Students may observe actual mediations conducted at the Equal Employment Opportunity Commission. Experienced attorneys will join the class to discuss the "real world" use of ADR from a plaintiff's and a defendant's perspective.
